فماذا لو كان اليوم حقا هو نهاية هذا العالم؟


لسنوات وعقود أمن الكثيرون في أرجاء الدنيا، بناءا على قراءة شهيرة فيما تركته لنا حضارة المايا، أن اليوم ٢١ ديسمبر ٢٠١٢ هو نهاية هذا العالم الذي نعرفه. وبينما أنه البعض مؤخرا قد أعادوا ترجمة ما نُقل عن المايا ليقولوا أن ما قصدوه هو نهاية هذه المرحلة من حياة العالم والإنسانية وبداية مرحلة أكثر إيجابية، إلا أن فكرة أنه يوم زوال العالم لا تزال تداعب خيال البعض. فماذا لو كان اليوم هو فعلا أخر يوم في العالم؟ ماذا كنت سأفعل في مثل ذلك اليوم الذي ليس له مثيل؟

أولا، سأستيقظ مبكرا، مبكرا للغاية، وسأرى شروق الشمس، وسأشتم هواء الفجر البارد والمحلّى بأثار الندى. سوف أكون أول إنسان في الشارع، وسيكون خاليا لدرجة أنني سوف أستمع إلى صدى صوت خطواتي في الشارع الخاوي والساكن. ثم في بيتي مرة أخرى سوف أشرب كوبا ملتهبا في سخونته من الشاي بالنعناع، وسوف أشربه ببطئ شديد، وسأتذوق كل قطرة فيه وكأنها مشروبا مستقلا في حد ذاتها. وربما أضيف قطعة بسكويت، أو وربما سأكل سندوتشا من العيش البلدي الطازج (إذا كان المخبز يعمل في مثل ذلك اليوم) والجبنة الرومي القديمة التي تم تسخينها على البوتاجاز. أعرف أن تسخين العيش على البوتاجاز مضرا بعض الشيء، ولكن هذا هو أخر يوم في العالم. بالتالي، فلا توجد أزمة إذا. ثم أتناول شيئا حلوا، ربما حلوى عربية، ربما شيكولاتة ما، ربما نوعا من الكعك، وربما بعض من كل ما سبق. حسنا. سوف أكل بعضا من كل ما سبق بالفعل. ولما لا؟

ثم سأعود إلى الشارع، وسأسحب كل ما يمكن أن أسحبه من حسابي البنكي المُحرِج والمؤلم، وسأملأ سيارتي بالوقود، وسأملاء صفيحة ما ببعض الوقود إحتياطيا. ثم سأقود في شوارع القاهرة قبل أن تمتلئ، فأراها مرة أخيرة دون إزدحام، دون عراك، دون ضوضاء، دون أن أرى الفقر ينهش أجساد البشر ممن يجلسون على الرصيف أو يطوفون الشوارع طامعين في لقمة عيش يعطف أحدهم بها عليهم، ودون سياسة. سيكون الشارع ساكنا حتى أنني سأسمع صوت إطارات السيارة وهي تفتت أثناء سيرها الأحجار الدقيقة المتناثرة على الأسفلت.

ثم يستيقظ الناس، وسأذهب بحثا عن هاتفي، وسأتأكد أنه مشحونا، وسأشتري بطارية أخرى وسأشحنها، وسأشرب حينها كوبا أخرا من الشاي...

وسأبدأ في الإتصال بكل من أخطأت بحقه، وسأعتذر له، ولن أغلق الإتصال حتى أشعر أنني فعلت كل ما بوسع لإقناعه بمسامحتي. ثم سأتصل بكل من أخطأ في حقي أنا ولا زلت أجد في نفسي قدرة على مكالمته، وسوف أخبره أنني أصفح عنه، وأمزح مزحة ما معه حتى يشعر أن كل شيء على ما يرام. وعلى الأرجح، فأنني سوف أكرر المزحة ذاتها مع كل الأشخاص الذي سأتصل بهم بدلا من التفكير في أكثر من مزحة، ولن يهم ذلك في شيء حيث أنه اليوم الأخير في العالم على أي حال. وربما أتصل لكي أصب غضبي الذي كتمته طويلا تجاه البعض، وربما أتحكم في ذاتي وأدع من إستحق غضبي لحاله في مثل ذلك اليوم. بالإضافة، فأنني سأتصل بكل من علمني شيئا جعل مني إنسان أفضل، سواء أن كان مدرسا أو إنسانا عاديا تقطاطع طريقي مع طريقه، وسأقول له أنه جعلني كذلك بالفعل من وجهة نظري: إنسان أفضل. كما سأتصل بأقاربي لأقول لهم أنني غني الحظ أن الله وهبني إياهم. وأخيرا، سأتصل بأقرب أصدقائي الذين ممن يمكنني أن أراهم في ذلك اليوم، وسأقول لهم كم يعنون لي حقا. فهم إختاروني وكانوا لي كالأهل، بينما ليس دمهم من دمي، وليس إسم عائلتهم من إسم عائلتي.

سوف ألبس أكثر ما أُعِز من ملابسي في هذا اليوم،  ثم سأُخرج كل ما لدي وتبقى من رداء، وسأعطيه لمن لم يلبسون مثله في حياتهم قط. وسوف أنظر في كل مقتنياتي وأعطي كل ما لن أحتاجه منها في ذلك اليوم لمن يمكنه أن يسعد ولو قليلا بها في ذلك اليوم. سوف أعطي كاميرتي المنهكة لصديق، ودراجتي الأكثر إنهاكا لطفل، ولكنني لن أعطي كتبي لأحد. أريد أن تكون كتبي معي، حتى في ذلك اليوم. وسوف أقرأ للمرة الأخيرة بعضا من جبران، وسيبتسم قلبي كما يبتسم وجهي لقراءة كلماته. فهناك شيئا لا يمكن أن أصفه في أن تقرأ الكلمات التي تعرفها مسبقا، فتذوب فيها وتفهمها وتُحدث روحك بما لا يمكنها أن تفعل لو كانت تلك هي أول مرة تقرأها فيها.

سأذهب إلى متجر ممن يبيعون العطور الأجنبية، ومتجر للعطور الشعبية، وسأشتم كل الروائح التي يمكن لأنفي أن تختبرها، حتى تفقد أنفي قدرها على إشتمام أي شيئ بعد حوالي ربع ساعة في كل من المحلين. ومنهما سأذهب إلى مطعم صغير ولكنك يمكنك أن ترى النيل (نعم، أعتذر عن الكليشيه) أو مشهدا رائعا منه، وسأكل القليل من كل شيء في القائمة، وربما أعقد إتفاقا مع يوجد غيري بالمطعم على أن نقتسم كل ما هو في القائمة. أريد أن أتذوق البعض من كل شيء. وسأكل التشيزكيك بكميات مرعبة، ولن يوقفني شيئآ سوى قدراتي الشخصية.

ثم، سأكتب. سأقول رأيي في كل شيء، عن الدنيا والإنسانية والسياسة وكرة القدم، دون تنميق، دون إكتراث، دون محاولة لإرضاء أحد، ودون محاولة لعدم إغضاب أحد. سأقول ما أعتقد أنني أعرفه، ثم سأنشره على مدونتي أو موقعا ما إن كان الإنترنت لا يزال يعمل ذلك اليوم. وعلى الأرجح، فلن يعلق أحدا مهما كان ما سأقوله مفزعا أو غريبا أيا كان، فلن أكون الوحيد الذي سيكتب شيئا مثل ذلك، ولن يهم الغير أغلب ما سأكتبه في مثل ذلك اليوم على أي حال. ولكنني سأشعر أنني صرت أكثر حرية، وذلك كل ما يهم.

ثم، سأقفز بالباراشوت، إن كان ذلك سانحا. نعم، الباراشوت. وسأختبر شعور الطيران في حياتي، وسأثير فزع طائرا ما أثناء طيراني عندما يجدني في مكان ليس من المفترض أن أكون به، ولن أخاف كثيرا مما أي عطب يمكنه نظريا أن يصيب الباراشوت.

ثم، سأفتعل عذرا لأراها...

ولابد من أن يكون عذرا ضخما حتى تقتنع هي أن تترك مخططها لأخر يوم في العالم ولو قليلا. وعندما أراها، فسوف أتناول يدها لكي أصافحها، وسأطيل في مصافحتها، حتى تسرق أناملي قطرات من عطرها ضلت طريقها إلى راحة يدها. سأصارع نفسي حول إذا ما كنت سأبوح لها عما أشعر به أم إذا كنت سأظل صامت الكلمة وناطق الوجه، ولا أعرف ما سيكون نتيجة ذلك الصراع. وسأنظر جيدا إلى وجهها بينما أنا أتحدث في لا شيء ذو قيمة وبكل بطئ ممكن، وسوف أحفر صورتها في ذاكرتي مرة أخرى، كل نقطة في وجهها الذي أحفظه بالفعل، كل شعرة من شعرات رأسها. وبالقليل الكثير القليل مما أعطتني إياه في تلك اللحظات التي كانت من نصيبي، سوف أتركها تذهب، بينما هي تظل بداخلي ولا تفارقني أبدا، مهما حاولت.

ثم سأذهب إلى ذلك المقهى الذي أذهب إليه تقريبا كل يوم، وسأحاول أن أجمع هناك أقرب الناس إلي من أصدقائي، وسنمزح مزاحا به بعض التوتر، ولكننا سنكون سعداء أننا رأينا بعضنا البعض في هذا اليوم، وأننا كنا معا اليوم كما كنا معا في كل يوم، كما كنا سنظل معا لو كان للدنيا بقية.

ثم، سأعود إلى منزلي، وسأقبل بعيناي كل ركن فيه، كل خدش في حائط كان بسبب لحظة لم أنساها أبدا أو نسيتها قليلا فتذكرتها اليوم، كل ذرة تراب كانت بعيدة فلم أستطع تنظيفها أبدا، كل كوب به شرخ صغير ولكنه إستمر يسقي ويسقي بمعجزة ما دون أن يتشقق على مدار سنوات، وذلك التلفاز المهول القديم الذي لا يزال يعمل بعد أن إشتريناه منذ قرون، وتلك البطانية التي تمثل أقدم ذكرى يمكن لعقلي أن يستحضرها ولازلت أتدثر بها، وبها رائحة لا أعرف سوى أنها رائحة الطمأنينة. ثم سأذهب إلى عودي وجيتاري وأقوم بضبطها ولعب ما يمككني أن ألعبه عليهما، ثم إلى البيانو الذي لم أجد الفرصة لكي أتعلمه بالقدر الذي أردته وسأفعل به كل ما أستطيع أن أفعله. ثم، أستمع إلى الموسيقى. سأستمع إلى فيروز وعبد الوهاب وباخ وباكو دي لوسيا ومطربا مصريا أخجل من القول أنني أستمع أحيانا إليه، وسأقوم بخفض الصوت قليلا قبل أن أستمع إلىه حتى لا يسمع ذلك من معي بالمنزل. الشجاعة لها حدود.

ثم، سأخرج لأجلس وسط أهلي، وسنأكل شيئا دافئا، وسنشاهد شيئا لسمير غانم، وسنضحك، وسيمكنني أن أجلس بينهم لسنوات وسنوات، وسأحمد الله أنني بينهم، وسأحمد الله على كل ما وهبني إياه.

Why This Was Not A Real Compromise

I will write a more extended article tomorrow about why I think the Egyptian Presidency's recent batch of decisions were not real "compromises," but I wanted to make a few points quickly as I have been stating them on twitter and media. I have five minutes to write, so I will not pay much attention to eloquence here.

Yes, by cancelling the previous Orwellian constitutional declaration and setting a potential roadmap in the case the constitutional draft was struck down in a referendum, it could be argued that the president made some step towards the centre. However:

1- The recent package of decisions announced by the national dialogue team does not represent real compromise because the President has largely gotten what he wanted from his original constitutional declaration, even now as he rescinded it. In short, he has managed to let the constituent assembly finish its controversial draft constitution, despite walkouts from the assembly by all liberal members, feminist and human rights representatives, the Church, the advisory committee and more - leaving only Islamist forces and affiliates forming a total of 86 people on the final voting day.

2- The president had promised he would not subject the document to a referendum before national consensus was achieved. Adding on the final lines in the previous point, this is certainly not the case. Egypt is more divided than ever right now, and these are not the conditions wanted for what was hoped to be the first democratically-made constitution in the history of the country. No one is claiming that everyone was going to agree on everything in any final document, but more consensus could have been reached on how to resolve the current constitutional conflict, regardless of the direction used.

3- Egyptian expats will vote in a few days, whereas the rest of Egypt will vote in less than a week. That means that several million Egyptians have only a few days to understand and decide on the document that should decide the fate of their nation for years and decades, while the rest of the population has less than a week. Bear in mind that this is an exhausted population following the revolution's aftermath, many of whom work 2-3 jobs to make ends meet, and with more than one third of the country illiterate. While I openly object to the constitutional draft and would vote "No" to it today, there is still an interesting additional note: I have followed every document released by the assembly from day one, analysed and written about them, attended formal discussion groups on the documents, have studied relevant academic material in my education, and I - and others like me - are actually still discovering new perspectives about this document till this day! What would a normal citizen do? People need at least a month to study this document and make up their minds in an informed decision. Trying to rush the referendum appears to be an attempt to capitalise on current conditions to secure a yes vote.

4- The current prosecutor-general will remain, who is already appearing to be controversial in some of his actions. A revolutionary demand was that the judiciary would nominate the PG or at least nominate candidates for the president to choose from. Instead, the president did what Mubarak did and appointed someone directly, allowing critics to ask questions over influence and affiliations.

5- The president's decisions again took the form of a constitutional declaration. The opposition and others, including Tarik Al-Bishry who led the process of drafting the March 2011 constitutional amendements, do not believe that he has the legal power to issue such declarations. The president swore his official oath to the current March 2011 constitutional declaration. In doing so, he has vowed to uphold it. If he wishes to amend it, such amendments should - theoretically - be done through referendum. And yet, despite issuing a declaration, the presidency does not want to amend the article on the time of the referendum, legally set as 15 days from the reception of the draft constitution. But even without that, it is argued that in a state of national crisis such referenda could be delayed. The country is in a deep security problem and even the safety of voters could - theoretically again - be at stake. On that basis alone the referendum should be delayed. The referendum has to be delayed, if there is any real desire by the administration for people to actually make some informed opinion of any kind. I have asked tens of current yes and no voters, and many are basing their decisions on things that are either inaccurate or had changed from previous drafts!

And yes, the opposition have not done well within the content of their last few moves. I will write in detail about that later.

I will probably update this post again based on some questions or comments that I get, or follow up thoughts. But I wanted to get this out there fast.

Update:

One note I remembered, one point that was also discussed was whether or not this constitutional referendum also have some conditions on turnout quorum and minimum required percentage for passage.

Egypt's Ten-Year Constitution?

It's no secret that Egypt's draft constitution process is in a gridlock right now, between Salafists who want more express references and influences to and by Shari'a, and liberals (or liberal-leaning members) who are threatening to exit en masse (30 of them) from the constituent assembly, potentially bringing the assembly down due to an insufficient number of members. One idea that has been circulating as of late is a proposal by political science professor and post-revolution government advisor Dr. Moataz-Bellah Abdel-Fattah. For those who don't know him, Abdel-Fattah became under the limelight following the revolution, writing on democratic transitions and as well as on a progressive approach to the relationship between Islam and the State.

In a recent Op-Ed In Shorouk, Abdel-Fattah floats the idea of a temporary ten year constitution that - more or less - would include largely only what all forces agree on. After ten years, a new one would be drafted or this one would be extended. Abdel-Fattah then goes on to discuss long-duration and problem-filled constitution-drafting experiences from around the world that would supposedly support his argument.

While some criticised Abdel-Fattah for potentially "confusing" and derailing the constitution-drafting process with such ideas, other see the idea itself as useful as a potential way to move the country forward and focus on actual national reconstruction for a while until we sort some of our constitutional stumbling blocks over a comfortable distance of 10 years, Others see the benefit in being a pressure tool against the assembly to finish its work in a more reconciliatory tone.

The idea is not entirely without merit, though not entirely the best idea in the world either. But even if it is a good idea, I can see liberals going for it, the Ikhwan potentially going for it, but the Salafists would not probably go for it at all. The sense of urgency and immediacy towards the revolution on the Salafist side is much stronger. Of course, some worry that temporary things usually become permanent, and they're largely right. But even if, would that necessarily be a bad thing? Would a temporary small constitution featuring almost only consensus articles be a bad thing if it become permanent? Some think not, some think so.

The girl in the photo is the brave 14-year old Pakistani girl Malala Yousafzai, recovering now - though still in dangerous condition - from an operation to remove a bullet to her head and another to her neck by the Taliban, who shot her because of her continuous courage to stand up in demand of her rights, particularly the right to educaion. Read about her and pray for her.

مغامرات عم سيد وعبد الله والثورة والصندوق والشارع والشاي و"البقعة"

- منتصف فبراير - سنة ٢٠١٠ - نهارا، سائق أعرفه يدعى (لغرض هذه المقالة) عم سيد يمتلك سيارة أجرة، وبينما أقوم بشراء كوبا من الشاي من مقهى يقع في أول الشارع الذي أقطن به، فإذا بعم سيد يدخل الشارع عكس الإتجاه القانوني. إستوقفته وقلت له أن ذلك لا يصح، فقال لي: "يا عم باسم البلد دي هي كده. البلد دي لازملها ثورة عشان تنضف! غير كده متقولليش عكس الإتجاه وبتاع. مش شايف وساخة الشارع أساسا عاملة إزاي؟!" القطط تفترس محتويات صندوق القمامة والذي سقط أرضا كعادته. هناك بقعة محددة في ذلك الشارع لم ينظفها أحدا منذ عرفتها منذ أكثر من ٢٠ عاما.

- منتصف فبراير - سنة ٢٠١٢ - نهارا، أقف مرة أخرى عند نفس المقهى. أسمع صوت شجار، فألتفت لأجد عم سيد يشتبك مع سائق أخر. بعد التقصي، إكتشفت أن عم سيد حاول دخول الشارع عكس الإتجاه القانوني، وإشتبك مع السيارة التي تخرج منه بشكل قانوني. سألت عم سيد في ذهول لماذا يشتبك وهو على خطأ فقال: "يا عم باسم هي البلد دي هي كدة. ويعدين إحنا لسة خارجين من ثورة. إحنا عايشين في غابة. يعني كله بالدراع."

غلب الطبع التطبع.

أحبطّني يا عم سيد. الله يسامحك يا عم. طلعت زي مشروع النهضة.

وإذا بعبد الله يتصل بي في التليفون فجأة بعد ذلك بيومين، فقط ليسلم علي، وكانت تلك المرة الثانية التي يحدثني فيها منذ ذلك اليوم، وذكرني بأنه مستعد لأن يعزمني على الشاي وقتما أكون قريبا منه. نظرت إلى البقعة التي نظفها، فإذا بها لازالت نظيفة. وكان هناك صندوق قمامة جديد مثبت جيدا أحضره إحدى سكان العمارة المقابلة، ولم يسقط أرضا حتى الآن.

Regarding The Guide To Egypt's Challenges

A few weeks back I had planned to write a small piece on the problems facing Egypt, given that now it had its first democratically elected president. After one day of thinking and researching, I finally set out to write the piece when I come across a fantastic post by Juan Cole that resembled largely what I had in mind, and took it a step or two further. My first impulse was: "oh, okay. That's it then."

Then, a few hours later I think: what if I develop something that could become a long term reference? Something that pretty much aggregates and analyses information on where does Egypt stand now, hopefully breaking down some of the problems into components that could be separately addressed. A couple of weeks later of on and off work, and the guide was born.

I plan to continue working on the guide. New sections might be added, information might be updated based on progress, and some are suggesting revisiting after one year to see where things stand in comparison.

For now, I would like to thank a few people.

First, the incredible Fouad Mansour of Ahram Online who has helped me tremendously throughout this project. It's just every writer's dream to work with an editor like that. I would also like to thank Dina Samak, Ahmed Feteha and Zeinab Mohammed, among others, from the Ahram Online team.

“Is this all the remaining opposition to the Brotherhood?!”

While going through the twitter timeline on August 24, I have come across such a statement in one form or another, one tone or another, one intended meaning or another. After much prolonged hype, only several thousand protesters in Cairo, and lesser numbers in a few governorates, marched while canting with fervent passion “down with the rule of the Morshid!” - the “Morshid” being the Arabic word for the Supreme Guide of the MB. Eventually, their numbers declined into several hundred, then dwindled to tens as they staged a sit-in by the presidential palace to voice their demands, led by former MP Mohammed Abu-Hamed. While some appeared to suggest that the images demonstrate that opposition to the Brotherhood was effectively negligible, and some did indeed echo that sentiment across the social media sphere (not just non-Egyptians) the statement was rather quite far from the truth, despite all the problems facing Egypt’s liberal opposition. In fact, a quick glance at the same social media on August 24th and beyond revealed what appeared to be a significant  (albeit questionable) satirical derision of the protests and the protesters, almost equally from many Islamists and Secularists observers and commentators alike. As of late Sunday evening, Abu-Hamed announced he had ended the sit in, while few protesters remained on their own. Then, a couple of days later he called for new protests on the 6th of October against the "hegemony of the ikhwan," intentionally coinciding with the anniversary of the October War.

The reality is that much of the more mainstream opposition forces to the Brotherhood itself decidedly boycotted the “August Revolution,” never did any rallying for them, some even used harsh rhetoric against them, and they did so for several reasons.

The first was the identity of those spearheading the call for protests themselves. On one hand was the infamous Tawfiq Okasha, the owner and chief host of the Nationalist Al-Faraeen TV Channel. Okasha and his channel have been the subject of criticism by a wide spectrum of Egypt’s political forces and even the media community for what has been consensually deemed to be unprofessional conduct, a continuous espousal of conspiracy theories that would make Glenn Beck appear to be a Renaissance man, and non-stop slander of activists and politicians.

The second - and principle - leader of the “revolution” has been the increasingly controversial former MP Mohammed Abu-Hamed. A financial consultant who first gained limited fame as a teacher of the Quran, Abu-Hamed was catapulted to the forefront of the post-revolutionary Egyptian scene as a leading member of the liberal Free Egyptians Party, as well as being the party’s star candidate for the parliament. Abu-Hamed was heavily presented as someone who could reconcile Islamic religious tradition and liberalism, while his youth, his sharpness, his initial well-spoken manner as well as some of his earlier actions excited many on Egypt’s pro-revolution and liberal fronts. However, almost as fast as he skyrocketed, Abu-Hamed commenced a sharp decline.

His increasingly angry rhetoric and form in the media began to alienate some of his base (though it gained him the support of a few others as well.) Then, in a startling move, the former MP gave a speech in Lebanon addressing Samir Geagea, a former Lebanese Forces leader who was convicted for crimes during the Lebanese Civil war. According to heavily-circulated news reports (I have not watched the speech in full), Abu-Hamed referred to Geagea as an inspiration, a “symbol of revolution and standing-one’s-ground in the entire Arab world,” a “Christian Muslim” who is “a symbol of the Islamic-Christian partnership in the land of Lebanon,” only to end his speech by “Thank you, our sir. You have inspired us.” (Quotes via AMAY) The speech, as well as his attempted clarification of his words, both created an avalanche of criticism from which the former MP’s image could not effectively rebound. Abu-Hamed also resigned the Free Egyptians Party amid speculations of internal discomfort with his conduct as well as a growing ambition (at 39, he had announced he would run for President if the laws governing the elections were amended to allow candidates younger than 40), and began founding his own “The Life Of Egyptians” Party, whose name was likened to the title of a dubbed telenovela. Moreover, after previously espousing anti-SCAF rhetoric and calling for trial of its members, Abu-Hamed came out vociferously in support of the Military Council as well as of Ahmed Shafiq in the Presidential Elections, a secular candidate with some association with the previous regime. The latest in a line of controversial statements was when Abu-Hamed recently suggested that the pyramids were "more sacred" than Al-Aqsa mosque in a video taken of him speaking in a church about the discourse on identity in the Egyptian state.

And with both Abu-Hamed and Okasha previously coming out in strong support of Shafiq in the elections as well as Okasha’s general staunch support of Omar Soleiman and SCAF, the protests were  substantially dubbed as felool protests - with “felool” being the word for a remnant of the former regime.

Then there were the demands of the “revolution” itself. In the earlier build up to the protests there seemed to be a general understanding that these protests were calling for downfall of Mohamed Morsy, the dissolution of the Brotherhood and even seemed to be welcoming a military coup. With Morsy being an (just-) elected president however, there was no sense in liberal movements roaming the streets calling for his downfall. Moreover, with Morsy managing to neutralise former intelligence head Murad Mowafi as well as SCAF’s Tantawi, Sami Anan and much of the military council in his historic reshuffles, and with the earlier passing away of Omar Soleiman, the organisers of the “August” revolution knew they had lost their potential trump cards. Demands were “lowered” to primarily include the official registration and legal oversight of the Brotherhood’s funding and activities, enacting laws against politicised appointments to state institutions to prevent the “Ikhwanisation” of the state, investigation of prison breaks and police station-burnings during the revolution and any potential role of the MB therein, dissolving the current “sectarian” constituent assembly, calling for a new coalition government to replace the government of PM Hisham Qandil, and others. And according to El-Badil newspaper, Abu-Hamed had also stated that if enough people joined the protests, he would call for a 5-man presidential council which would include Morsy as well as military and other figures to run the country while a new constitution was set. The Sunday following the protests, Abu-Hamed was referred to investigation over accusations of plotting to overthrow the elected president and his government following a complaint by a citizen who claimed, according to Ahram Online, that he had evidence of the former MP receiving aid while in Lebanon with the goal of inciting sectarian strife.

Then there was the eventual public perception. Other than those who did participate or sympathised with the protests, by the end of the countdown public opinion seemed to be  largely divided between those who felt these protests were objectionable, those who felt they would amount to nothing and those who were being affected by claims that violence and destruction allegedly set to happen on the 24th. The FJP's site, as a part of what seemed to be a wider propaganda anti-campaign, even published a macabre claim on the eve of the protests that a "source" told them that Ahmed Shafiq was setting 5 million dollars to hire 22,000 thugs, was coordinating with "leftists and liberals" who supported his campaign as well as fired SS officers and former NDP men, was planning to attack vital state institutions and prison stations, and mentioned incredible prices for the thugs and hired fake protesters among a list of other claims that appeared to be taken from the former regime's propaganda playbook.

Of course, this entire affair raised many questions and comments. Setting aside the August 24 protests themselves, some lamented the overall form of the anti-Ikhwan opposition and its landscape in general, the fragmentation of the opposition, questioned who can speak in its name, and some of course wondered whether such an opposition theoretically has capability of rallying massive amounts of people into the streets if ever desired to do so.

One other question remained on how the more mainstream and post-revolutionary opposition groups could handle the expected return of Ahmed Shafiq to Egyptian politics and his allegedly soon-to-be-announced new political party. Shafiq, who only lost the elections by a relatively narrow margin, is a self-styled liberal and a staunch anti-Brotherhood opponent who still theoretically commands considerable support, but bears the label of “folool.” Some, of course, wondered if the word felool would ever have an expiration date, and questioned definitions of it.

The return of Ahmed Shafiq or an anointed successor to the helm of a political party or movement could “theoretically” either lead to the creation of a wider liberal alliance that would, however, be more easily publicly defamed as aligning itself with the former regime, or create an even more fragmented and competitive liberal/secular front. Both options would be painful in the course of fast approaching parliamentary elections wherein the liberal front is desperate for a united concerted effort.

On The Freedom Of Media, And Article 179


I was having a conversation regarding the question of media freedom in Egypt and the recent crackdowns and/or investigations against certain media figures, and I was asked to put down the thoughts I had stated into an article or a post. Well, here they are.

There is virtually no doubt that Tawfiq Okasha's Al-Faraeen TV channel represents an unflattering spot in the history of, not just Egyptian or Arab but even, world media. The channel has been the subject of condemnation of figures from across the political spectrum as well as various media professionals. But the problem with Al-Faraeen, however, is that it was suspended by an administrative order rather than a court decision, setting an alarming post-revolution precedent. This is even more regrettable given the fact that there are countless valid legal arguments for shutting down the channel or suspending it using legal due process, and that there has already been one or more existing verdicts to such an effect that have not been enforced.

Similarly, Al-Dostour newspaper appeared (through my limited intermittent contact with it) to be not quite shy about recounting grand tales of macabre conspiracies by the Muslim Brotherhood without appearing to have provided any substantial evidence for such claims, again - valid legal grounds for investigation. Some observers even accuse it of calling for a military coup against a sitting democratically-elected president in a recent front page (a reading of that page's seemingly intentionally vague final paragraph seems to support this accusation). But the problem here was the (yes, court ordered) confiscation of new issues of the paper, its potential shutting down. We thought confiscations were a thing of the past.

Then, a few overriding concerns.

1- A wide majority of the journalistic community has long demanded an end to prison sentences for crimes pertaining publishing, and to have imprisonment be replaced with financial punishment through varying fines. Both Okasha and Al-Dostour's Islam Afifi (in addition to recently summoned editors-in-chief Abdel-Haleem Qandeel and Adel Hammouda) now face the possibility of prison sentences.

2- While the falsification of news or the incitement to inflict harm against any citizen and - by extension - any state official should be a punishable crime, these media figures also face accusations under the Orwellian article 179 of the penal code that makes it a crime to "Insult The President." As I understand, that article was also used against (former Al-Dostour, and current Al-Tahrir, editor in chief) Ibrahim Eissa by the Mubarak regime to put him behind bars, and also used in parliament against former MP Ziad El-Eleimy to justify punishment against him for the alleged insult of then-acting president Field Marshal Hussein Tantawi. While I find insults and non-constructive criticism in media against state officials to be regrettable and unnecessary, I believe that they should not be criminalised, especially in a nascent democracy like ours with a recurring historic precedent of turning leaders into untouchable figures.

3- The legal code itself is full of archaic and incredulous articles. The code (I am being told this is up-to-date, and excerpts of the pertinent articles have been used as of late in the media) includes articles such as 98bis which punishes any person or entity forming a group that would threaten the "foundational principles upon which the nation's socialist system" is founded, which is both darkly humourous and dumbfounding given how the reference to socialism has been dropped from the constitution in 2007, and given how it is moronic article to begin with. Section one of article 174, as I understand it, punishes those who call for the "hatred or contempt" of the system of government using any media. Article 180 punishes by imprisonment anyone who insults a foreign head of state in the media as well. Article 185 also punishes anyone who similarly insults pretty much any state official or judge. Article 178 appears to be punish those who display "improper facets" of the state, among other things. Article 183, as I understand it, punishes (again by imprisonment and/or fine) anyone who insults pretty much any state institution, including parliament. The criticisms go on and on, both of the intention of the articles themselves, their phrasing, and the designated punishments. And the reason I keep using the expressions "as I understand it" and "as it appears" is due to the often too rubbery and vague phrasing of the articles, which both can be a blessing or a curse for a defendant, a tool for mercy or oppression by the judge.

4- This all is happening at a time where other alarming media trends are occurring. The parliament's upper house, dominated by the MB, continued the former regime's tradition of appointing the heads  of state newspapers and print-media organisations (which also were the subject of many calls of reform themselves), with the appointments garnering wide criticism both for taking place to begin with (rather than using other means that grant independence to these publications) as well as for the actual choices of editors-in chief which have largely been controversially described as either Islamist-leaning or easily-controllable.

Already there have been reports of articles criticising the MB being censored in such papers, while Al-Akhbar (the second leading state-owned Egyptian daily) cancelled one of its op-ed pages that  prominently featured writers not belonging to the organisation, with journalist Youssef Al-Qaeed describing the rationale behind the move as silencing a page that essentially featured critiques of the MB and Islamists (the paper argued the move was to cut costs and to give a chance to the institution's own writers.) 

5- And while the abolishment of the Ministry Of Information has long been a popular consensual demand of all revolutionary forces (it was briefly abolished after the revolution only to be returned by a SCAF-supervised government), president Mohamed Morsy and his cabinet did not axe the ministry either, and instead appointed a Brotherhood figure to the post. While there have been reports that this minister claimed he would be the last such minister, it would have significantly been better to take immediate moves to ensure seriousness regarding the abolishment of the ministry and transforming it and its dependent media into a BBC-like independent organisation, at least appoint a non-partisan choice for the post or even a multi-person committee charged with managing the transition. Further, the MB has been criticising the media as being unfairly biased against them, and protesters who were described as belonging to the Muslim Brotherhood were reported to have attempted to block the Media Production City while protesting and there were reports of "attacks" on media figures there, though they appear to have been somewhat exaggerated in detail. This has all been feeding the fuels of suspicion for some that there are moves by the Brotherhood to control the media.

The point is that there needs to be a serious conversation on, and immediate attention to, what is taking place in Egyptian media; regarding both the transformations already occurring as well as the ethics and proper conduct of the profession. There also needs to be an immediate project on the reform of media and the articles of the penal code pertaining to it (in addition to an overhaul of the code itself in its totality). But most immediately: archaic and Stalinist articles pertaining to the insult of state officials and institutions need to be abolished, and charges based on them need to be dropped, a clear timeline and concrete steps towards the abolishment of the "Information" Ministry must come forth, and criticisms of the recent appointments of state media heads needs to be addressed. Otherwise, suspicions may not have entirely been hyperbolic.

The Slow Defence Of Freedom

The inexplicably banned book.

A few days ago a Mid-East history textbook was inexplicably banned, a book that had reportedly already been in use by the American University in Cairo for 10 years. There are varying claims of journalists/writers in state-owned newspapers and media being censored. The information ministry was not abolished, which was a unanimous revolutionary demand, and the parliament's upper house continued the tradition of appointing editors of state owned print media, this time choose controversial picks who are said to at least be likely to attempt to appease the new regime. 

And while Al-Dostour and Al-Faraeen are both, for me, tabloid media at best, their content is questionable and both could indeed deserve some legal investigation, there have been complaints that the recent moves against them and their figureheads were not done in the manner that would set the best possible modus operandi for such future pursuits.

Even debates on the potential restriction of freedom of worship in the next constitution, the continued detention of militarily-tried prisoners (until recent laudable moves by Mohamed Morsy to free them and/or reconsider their cases), the questionable trial of Egyptian actor over his body of work, and other questions of concern; there are more of these cases popping up each day. These questions reveal two problems:

1- Organised Power: despite a year and a half after the revolution, electoral alliances, a myriad of new political parties and civil rights initiatives, progressive forces have yet to organise an effective and strong front that can respond immediately to such challenges. The case of the banned book is just being addressed by "waiting," Adel Imam's case was just "harshly criticised" by many figures, and... you get the idea. A lot of anger, condemnation, waiting, and largely just that.

The lack of large, organised and ready groups that can be sufficiently co-ordinated to create real pressures on authorities and other political forces on such issues is direly being felt. For example, there should be a substantial stock of trained lawyers ready to be launched pro bono for such cases; a mechanism to peacefully use the street in expression of political demands; a coordination mechanism for the launch of new political development initiatives and - most importantly - the ability to sustain internal efforts and external interests on such cases.

Currently, most of these efforts appear to be undertaken by passionate smaller groups and individuals who usually do not have the resources or the capacity to mount large sustained efforts, nor succeed in effectively keeping the media's attention to their causes.

2- Organised Framework: the second, and inextricable, problem is that the continued lack of a formulation of a coherent progressive ideology has left such forces unable to properly and fully formulate their arguments against certain forms of censorship or challenges in a manner that might better gain the support of a wider segment of a society, one with a clear moderate-conservative leaning.

The point is: the more the precedents of such cases that are set without proper response mechanisms put in place and effectively used, the harder it will be to go back on such precedents, and the harder it will be to argue against repetitions of such cases. The time for all of this was yesterday. Today is still good though.

Is Syria Heading Towards Temporary Partition, a Green Line?

This is not an in-depth, analytical piece of real academic value. Just a wild thought I wanted to think out loud, caused by fasting more than a dozen hours in the heat of Ramadan.

I had several long conversations yesterday, the first day of Ramadan. None of them were about fasting, almost all were about Syria. Among the topics that stood out: what does the FSA really want to achieve in Damascus and onwards, and what can Assad's regime do now. The recent bombings that ended the lives of three top-ranking Syrian officials, including Bashar's brother in law, and reportedly significantly hurt his brother, suddenly pushed everyone towards the realisation that Assad and his regime may not be as strong as once thought, and that an Operation Valkyrie-like ending for Bashar and possibly his entire regime in consequence might even be possible any moment now. That, of course, prompted the question: what happens now, what happens next?

There are a few scenarios being floated already. Quickly: one assumes Assad uses the remainder of his firepower and Shabbiha to attempt to crush the FSA "at any cost," another even imagines the regime using chemical weapons to literally obliterate the resistance and - by extension - scores of citizens as well. Others assume the FSA would somehow win, whether through a continued series of assassinations that would wipe out regime figures, and/or high-ranking defections, possibly even an eventual coup. There is another scenario, very outlandish, but one that I wanted to throw out into the ether for the sake of pseudo-intellectual banter.

This scenario assumes that the best the FSA hopes to do in Damascus is apply pressure to both weaken the regime but to also pull away some army troops stationed outside of Damascus towards the capital, allowing the FSA to more fully free a few regions and establish safe havens outside of the capital, especially along the border with Turkey, an idea which has been called for before (John Mccain suggested it, even floating going in with air strikes à la Libya.) These zones would then come under FSA or SNC administration. If that happens, international forces could somehow end up being deployed by the border, or at least exist in a large humanitarian and reconstructive capacities, making it harder for the regime to attack such regions again without incurring the reprisal of real military power this time. A green line between regime-controlled and opposition-controlled regions is set.

If that - in turn - happens, one of two possibilities then could take place. This first would be that one side eventually pushes towards the other, if the situation allows for it. The second would be that a standoff ensues, with two governments ruling different parts of Syria, a modified North-South Korea situation that is likely to last a much shorter amount of time than its Korean counterpart, but still remain for some considerable time, until a permanent settlement is reached or imposes itself.

The potential consequences of such a move are manifold, and divergent. But potentially one of the largest of such effects would be on Arab public opinion, for which the idea of a divided Syria has been one of the most common conspiracy theories that were being toute for years and years. And, in this outlandish scenario (just reminding you that this is nothing more than a mental exercise), if the FSA/SNC regime does not win sufficient public endorsement as the NTC eventually did in Libya and much of the Arab world, the regime might find itself under less Arab pressure to fall, especially if it sacrifices Bashar. Instead of Libya, a variation of Yemen eventually perhaps, wherein the opposition and the regime work out a deal forward. Of course, that would not take place without the passage of a substantial amount of time with each side firmly behind the Green Line.

نص قرار المحكمة الدستورية المصرية في قضية مجلس الشعب

          بتاريخ 21 فبراير سنة 2012، ورد إلى قلم كتاب المحكمة ملف الطعن رقم 6414 لسنة 58 قضائية عليا، بعد أن قضت دائرة فحص الطعون بالمحكمة الإدارية العليا بجلستها المعقودة فى 20/2/2012 بإحالة الأوراق إلى المحكمة الدستورية العليا للفصل فى دستورية نص الفقرة الأولى من المادة الثالثة من القانون رقم 38 لسنة 1972 فى شأن مجلس الشعب المستبدلة بالمرسوم بقانون رقم 120 لسنة 2011، والفقرة الأولى من المادة السادسة من هذا القانون المستبدلة بالمرسوم بقانون رقم 108 لسنة 2011، والمادة التاسعة مكررًا ( أ ) من القانون المشار إليه المضافة بالمرسوم بقانون رقم 108 لسنة 2011 .
          وقدمت هيئة قضايا الدولة مذكرة، طلبت فيها أصليًا الحكم : بعدم اختصاص المحكمة بنظر الدعوى، واحتياطيًا : بعدم قبول الدعوى، ومن باب الاحتياط الكلى : برفضها .
          وبعد تحضير الدعوى، أودعت هيئة المفوضين تقريرًا برأيها .
          ونُظرت الدعوى على الوجه المبين بمحضر الجلسة، وقررت المحكمة إصدار الحكم فيها بالجلسة ذاتها .

          بعد الاطلاع على الأوراق، والمداولة .
          حيث إن الوقائع على ما يتبين من صحيفة الدعوى وسائر الأوراق تتحصل فى أن السيد/ أنور صبح درويش مصطفى كان قد أقام الدعوى رقم 2656 لسنة 13 قضائية، أمام محكمة القضاء الإدارى " دائرة القليوبية "، بطلب الحكم بوقف تنفيذ ثم إلغاء قرار اللجنة العليا للانتخابات بإعلان نتيجة انتخابات مجلس الشعب بالدائرة الثالثة فردى بالقليوبية، فيما تضمنه من إعادة الاقتراع بين مرشح حزب الحرية والعدالة ومرشح حزب النور على مقعد الفئات بالدائرة المذكورة، واستبعادهما وكذا مرشح حزب الحرية والعدالة لمقعد العمال بهذه الدائرة من بين مرشحى النظام الفردى، وما يترتب على ذلك من آثار، وقال شرحًا لدعواه أنه كان ضمن مرشحى النظام الفردى ( فئات مستقل ) بالدائرة الثالثة بالقليوبية، وقد أجريت الانتخابات وأعلنت اللجنة العليا النتيجة متضمنة عدم فوزه، وإجراء الإعادة بين مرشحى حزب الحرية والعدالة وحزب النور . وقد نعى المدعى على قرار اللجنة مخالفة أحكام القانون لأسباب حاصلها بطلان عملية الاقتراع وفرز الأصوات، وعدم دستورية نص الفقرة الأولى من المادة الثالثة من القانون رقم 38 لسنة 1972 المشار إليه المستبدلة بالمرسوم بقانون رقم 120 لسنة 2011، ونص المادة الأولى من المرسوم بقانون رقم 123 لسنة 2011 بتعديل بعض أحكام المرسوم بقانون رقم 120 لسنة 2011، والتى ارتكن إليها القرار المطعون فيه، وذلك لمخالفتهما لمبدأ المساواة الذى كفلته المادة (7) من الإعلان الدستورى الصادر فى الثلاثين من مارس سنة 2011، بعد أن ميزا بين المنتمين للأحزاب السياسية، البالغ عددهم ثلاثة ملايين، والمستقلين وعددهم خمسين مليونًا، بأن خصّا المنتمين للأحزاب بثلثى عدد أعضاء مجلس الشعب، وقصرا حق المستقلين على الثلث الباقى، يزاحمهم فيه المنتمون للأحزاب، فضلاً عن مخالفتهما لما قضت به المحكمة الدستورية العليا فى العديد من أحكامها، وبجلسة 9/1/2012 قضت تلك المحكمة فى الشق المستعجيل من الدعوى، برفض طلب وقف تنفيذ القرار المطعون فيه، وإذ لم يرتض المدعى هذا القضاء، فقد طعن عليه أمام المحكمة الإدارية العليا بالطعن رقم 6414 لسنة 58 قضائية عليا، وبجلسة 20/2/2012 قضت دائرة فحص الطعون بالمحكمة الإدارية العليا بوقف الطعن، وإحالة الأوراق إلى المحكمة الدستورية العليا للفصل فى دستورية النصوص الواردة بقرار الإحالة، لما تراءى لها من مخالفتها لأحكام الإعلان الدستورى المشار إليه .
          وحيث إن هيئة قضايا الدولة دفعت بعدم اختصاص هذه المحكمة بنظر الدعوى، على سند من أن النصوص المطعون فيها تعد عملاً سياسيًا، وأن طلب الفصل فى دستوريتها ينصب فى جوهره على الفصل فى دستورية نص المادة (38) من الإعلان الدستورى، وذلك الدفع مردود بأن الرقابة القضائية على دستورية القوانين واللوائح التى تباشرها المحكمة الدستورية العليا طبقًا لنص المادة (49) من الإعلان الدستورى، وقانون المحكمة الصادر بالقانون رقم 48 لسنة 1979، تجد أساسها كأصل عام فى مبدأ الشرعية وسيادة القانون وخضوع الدولة له، إلا أنه يرد على هذا الأصل وفقًا لما جرى عليه قضاء هذه المحكمة استبعاد الأعمال السياسية من مجال هذه الرقابة القضائية، تأسيسًا على أن طبيعة هذه الأعمال تأبى أن تكون محلاً لدعوى قضائية، والعبرة فى تحديد التكييف القانونى لهذه الأعمال، هى بطبيعة العمل ذاته لا بالأوصاف التى قد يخلعها المشرع عليه متى كانت طبيعته تتنافى وهذه الأوصاف، ذلك أن استبعاد تلك الأعمال من ولاية القضاء الدستورى إنما يأتى تحقيقًا للاعتبارات السياسية التى تقتضى بسبب طبيعة هذه الأعمال واتصالها بنظام الدولة السياسى اتصالاً وثيقًا أو بسيادتها فى الداخل أو الخارج النأى بها عن نطاق الرقابة القضائية استجابة لدواعى الحفاظ على الدولة والذود عن سيادتها ورعاية مصالحها العليا، مما يقتضى منح الجهة القائمة بهذه الأعمال سواء كانت هى السلطة التشريعية أو التنفيذية سلطة تقديرية أوسع مدى وأبعد نطاقًا تحقيقًا لصالح الوطن وسلامته، دون تخويل القضاء سلطة التعقيب على ما تتخذه فى هذا الصدد، ولأن النظر فيها والتعقيب عليها يستلزم توافر معلومات وضوابط وموازين تقدير لا تتاح للقضاء، فضلاً عن عدم ملاءمة طرح المسائل علنًا فى ساحاته . والمحكمة الدستورية العليا وحدها هى التى تحدد بالنظر إلى طبيعة المسائل التى تنظمها النصوص المطعون فيها ما إذا كانت تلك النصوص تعتبر من الأعمال السياسية فتخرج عن ولايتها بالرقابة القضائية على الدستورية، أم أنها ليست كذلك فتبسط عليها رقابتها . لما كان ذلك، وكانت النصوص المطعون فيها تتناول بالتنظيم الأحكام الخاصة بالترشيح لعضوية مجلس الشعب، والتى يتعين النظر إليها مع باقى نصوص القانون رقم 38 لسنة 1972 المشار إليه، باعتبارها كلاً لا يتجزأ، تتضافر وتتساند ليتحدد بها وفى ضوء تعيين مراميها ومقاصدها طبيعة وأُطر ومضمون النظام القانونى الذى اعتنقه المشرع وسنه لتنظيم العملية الانتخابية برمتها، والتى لا تدخل بحسب طبيعتها التشريعية ومضمونها المتقدم ضمن المسائل السياسية التى تنأى عن الرقابة القضائية على الدستورية . ولا يعد مباشرة هذه المحكمة لرقابتها القضائية على دستوريتها، مساسًا أو تعرضًا منها لنص المادة (38) من الإعلان الدستورى أو مدًّا لرقابتها عليها، ليبقى هذا النص مع باقى أحكام الإعلان الدستورى الأخرى القواعد الحاكمة لتلك الرقابة، ويكون الدفع بعدم اختصاص المحكمة بنظر الدعوى غير قائم على أساس سليم، متعينًا رفضه .
          وحيث إنه عن الدفع بعدم قبول الدعوى المبدى من هيئة قضايا الدولة، لاتحاد المحل فى الدعويين الموضوعية والدستورية، فذلك مردود أيضًا بأن من المقرر أن ولاية هذه المحكمة لا تقوم إلا باتصالها بالدعوى اتصالاً مطابقًا للأوضاع المقررة فى المادة (29) من قانونها، ومن ثم وتحقيقًا لما تغياه المشرع فى هذا الشأن، فإنه يجب أن تستقل دعوى الموضوع بطلبات غير مجرد الحكم بعدم دستورية نصوص قانونية معينة، وإلا كانت الدعوى فى حقيقتها دعوى دستورية رفعت بغير الطريق الذى رسمه القانون . لما كان ذلك، وكانت الدعوى الموضوعية تنصب على طلب وقف تنفيذ ثم إلغاء قرار اللجنة العليا للانتخابات بإعلان نتيجة انتخابات مجلس الشعب بالدائرة الثالثة فردى بالقليوبية، وهى طلبات تستقل بمضمونها ومحتواها عن الطلبات المحددة بالدعوى الدستورية الماثلة، والتى تدور حول مدى دستورية النصوص المطعون فيها، الأمر الذى يضحى معه الدفع المشار إليه فى غير محله، خليقًا بالقضاء برفضه .
          وحيث إن الفقرة الأولى من المادة الثالثة من القانون رقم 38 لسنة 1972 فى شأن مجلس الشعب المستبدلة بالمرسوم بقانون رقم 120 لسنة 2011 تنص على أن " يكون انتخاب ثلثى أعضاء مجلس الشعب، بنظام القوائم الحزبية المغلقة، والثلث الآخر بالنظام الفردى، ويجب أن يكون عدد الأعضاء الممثلين لكل محافظة عن طريق القوائم الحزبية المغلقة مساويًا لثلثى عدد المقاعد المخصصة للمحافظة، وأن يكون عدد الأعضاء الممثلين لها عن طريق الانتخاب الفردى مساويًا لثلث عدد المقاعد المخصصة لها " .
وتنص الفقرة الأولى من المادة السادسة من هذا القانون المستبدلة بالمرسوم بقانون رقم 108 لسنة 2011 على أن " يقدم طلب الترشيح لعضوية مجلس الشعب، فى الدوائر المخصصة للانتخاب بالنظام الفردى، من طالبى الترشيح كتابة إلى لجنة الانتخابات بالمحافظة التى يرغب المرشح فى الترشيح فى إحدى دوائرها الانتخابية، وذلك خلال المدة التى تحددها اللجنة العليا للانتخابات بقرار منها على ألا تقل عن خمسة أيام من تاريخ فتح باب الترشيح" .
وتنص المادة التاسعة مكررًا ( أ ) من القانون المشار إليه المضافة بالمرسوم بقانون رقم 108 لسنة 2011 على أن " تعد لجنة الانتخابات فى المحافظة، بعد انتهاء لجنة الفصل فى الاعتراضات المشار إليها فى المادة السابقة، من عملها، كشفين نهائيين يتضمن أحدهما أسماء المرشحين بالنظام الفردى، ويتضمن الآخر أسماء مرشحى القوائم، على أن يتضمن كل كشف الصفة التى ثبتت لكل مرشح والحزب الذى ينتمى إليه، إن وجد، والرمز الانتخابى المخصص لكل مرشح أو قائمة . وتنشر اللجنة العليا للانتخابات أسماء المرشحين كل فى دائرته الانتخابية وفى صحيفتين يوميتين واسعتى الانتشار .
          وكانت المادة الخامسة من المرسوم بقانون رقم 120 لسنة 2011 بتعديل بعض أحكام القانون رقم 38 لسنة 1972 المشار إليه والقانون رقم 120 لسنة 1980 فى شأن مجلس الشورى قبل إلغائها تنص على أن " يشترط فيمن يتقدم بطلب الترشيح لعضوية مجلس الشعب أو مجلس الشورى بنظام الانتخاب الفردى ألا يكون منتميًا لأى حزب سياسى، ويشترط لاستمرار عضويته أن يظل غير منتم لأى حزب سياسى، فإذا فقد هذه الصفة اسقطت عنه العضوية بأغلبية ثلثى أعضاء المجلس " . وقد تم إلغاء هذا النص بموجب المادة الأولى من المرسوم بقانون رقم 123 لسنة 2011 التى تنص على أن " تلغى المادة الخامسة من المرسوم بقانون رقم 120 لسنة 2011 المشار إليه " .
          وحيث إن المصلحة وهى شرط لقبول الدعوى الدستورية مناطها أن يكون ثمة ارتباط بينها وبين المصلحة فى الدعوى الموضوعية، وذلك بأن يكون الفصل فى المسألة الدستورية لازمًا للفصل فى الطلبات الموضوعية المرتبطة بها والمطروحة على محكمة الموضوع . لما كان ذلك، وكان النزاع الموضوعى ينصب على طلب وقف تنفيذ ثم إلغاء قرار اللجنة العليا للانتخابات بإعلان نتيجة انتخابات مجلس الشعب بالدائرة الثالثة فردى بمحافظة القليوبية، فيما تضمنه من إعادة الاقتراع بين مرشح حزب الحرية والعدالة ومرشح حزب النور على مقعد الفئات بالدائرة المذكورة، واستبعادهما وكذا مرشح حزب الحرية والعدالة لمقعد العمال بهذه الدائرة، من بين مرشحى النظام الفردى، وما يترتب على ذلك من آثار . وكان نص الفقرة الأولى من المادة الثالثة من القانون رقم 38 لسنة 1972 المشار إليه قد حدد النسبة المقررة للانتخاب بنظام القوائم الحزبية المغلقة، وتلك المخصصة للنظام الفردى، جاعلاً للأولى ثلثى أعضاء مجلس الشعب والثلث الآخر للثانى، وبينت الفقرة الأولى من المادة السادسة من ذلك القانون القواعد الخاصة بالتقدم بطلب الترشيح لعضوية مجلس الشعب فى الدوائر المخصصة للانتخاب بالنظام الفردى . وتناولت المادة التاسعة مكررًا (أ) من القانون رقم 38 لسنة 1972 المشار إليها الأحكام الخاصة بإعداد الكشوف النهائية للمرشحين، وأوجبت تضمين الكشف النهائى الخاص بالمرشحين بالنظام الفردى بيان الحزب الذى ينتمى إليه المرشح . وكانت المادة الخامسة من المرسوم بقانون رقم 120 لسنة 2011 سالف الذكر تشترط فيمن يتقدم بطلب الترشيح لعضوية المجلس بنظام الانتخاب الفردى ألا يكون منتميًا لأى حزب سياسى، وجعلت ذلك الشرط فوق كونه شرطًا للتقدم بطلب الترشيح، شرطًا لاستمرار عضويته بالمجلس، فإذا فقد هذه الصفة اسقطت عنه العضوية بأغلبية ثلثى أعضاء مجلس الشعب، غير أن المشرع ألغى هذا النص بموجب نص المادة الأولى من المرسوم بقانون رقم 123 لسنة 2011 آنف الذكر، بما لازمه اتجاه إرادة المشرع الصريحة إلى قصر نسبة الثلثين المقررة للانتخاب بنظام القوائم الحزبية المغلقة على المنتمين للأحزاب السياسية، وترك التقدم للترشيح بالنسبة للثلث الباقى المخصص للانتخاب بالنظام الفردى متاحًا أمام المنتمين لتلك الأحزاب إلى جانب المستقلين غير المنتمين لأى منها، وما من شك فى أن تقرير تلك المزاحمة كان له أثره وانعكاسه الأكيد والمتبادل مع نسبة الثلثين المخصصة للقوائم الحزبية المغلقة، إذ لولا مزاحمة المنتمين للأحزاب للمستقلين فى تلك النسبة لحدث إعادة ترتيب داخل القوائم الحزبية، بمراعاة الأولويات المقررة داخل كل حزب، فضلاً عن تمتع المنتمين للأحزاب بالخيار بين سبيلين للترشيح لعضوية المجلس، هما القائمة الحزبية المغلقة والنظام الفردى، والذى حرم منه المستقلين، ليقتصر حقهم على النسبة المخصصة للنظام الفردى، التى يزاحمهم فيها المنتمين للأحزاب، ومن ثم فإن المصلحة فى الدعوى الماثلة تكون متحققة فى الطعن على نص الفقرة الأولى من المادة الثالثة من القانون رقم 38 لسنة 1972 المشار إليه المستبدلة بالمرسوم بقانون رقم 120 لسنة 2011، وما تضمنه نص الفقرة الأولى من المادة السادسة من هذا القانون المستبدلة بالمرسوم بقانون رقم 108 لسنة 2011 من إطلاق الحق فى التقدم بطلب الترشيح لعضوية مجلس الشعب فى الدوائر المخصصة للانتخاب بالنظام الفردى للمنتمين للأحزاب السياسية إلى جانب المستقلين غير المنتمين لتلك الأحزاب، والمادة التاسعة مكررًا ( أ ) من ذلك القانون المضافة بالمرسوم بقانون رقم 108 لسنة 2011 فيما نصت عليه من تضمين الكشف النهائى لأسماء المرشحين بالنظام الفردى، بيان الحزب الذى ينتمى إليه المرشح، إذ أن الفصل فى مدى دستورية هذه النصوص سيكون له أثره وانعكاسه على الدعوى الموضوعية، والطلبات المطروحة بها، وقضاء محكمة الموضوع فيها . كما يمتد نطاق هذه الدعوى والمصلحة فيها إلى نص المادة الأولى من المرسوم بقانون رقم 123 لسنة 2011 المشار إليه، والذى يرتبط بالنصوص المار ذكرها ارتباطًا لا يقبل الفصل أو التجزئة، بما يجعله مطروحًا حكمًا على هذه المحكمة .
          وحيث إن حكم الإحالة ينعى على النصوص المطعون فيها مخالفتها لحق الترشيح، ولمبدأى المساواة وتكافؤ الفرص المقررين بالمادة (7) من الإعلان الدستورى، بعد أن سمحت للمنتمين للأحزاب السياسية بمزاحمة المستقلين غير المنتمين لتلك الأحزاب فى نسبة الثلث المخصصة لنظام الانتخاب الفردى، رغم استئثارهم بنسبة الثلثين المخصصة للانتخاب بنظام القوائم الحزبية المغلقة .
          وحيث إن المادة (1) من الإعلان الدستورى الصادر فى الثلاثين من مارس سنة 2011 تنص على أن " جمهورية مصر العربية دولة نظامها ديمقراطى يقوم على أساس المواطنة"، وقد حددت المواد من (32 إلى 41) من هذا الإعلان القواعد المتعلقة بانتخاب مجلسى الشعب والشورى . ومؤدى هذه الأحكام والقواعد أن المشرع الدستورى حرص على كفالة الحقوق السياسية للمواطنين جميعًا، وقوامها حقا الترشيح والانتخاب، وإبداء الرأى فى الاستفتاء، وتمكينهم من ممارستها ضمانًا لإسهامهم فى الحياة العامة، وباعتبارها إحدى الوسائل الديمقراطية للتعبير عن آرائهم واختيار قياداتهم وممثليهم فى إدارة دفة الحكم فى البلاد، وتكوين المجالس النيابية، ومن ثم تعد ممارسة المواطنين لحقوقهم السياسية، وعلى وجه الخصوص حقا الترشيح والانتخاب أحد أهم مظاهرها وتطبيقاتها، سواء كان ذلك بوصفهم ناخبين يتمتعون بالحق فى اختيار مرشحيهم على ضوء اقتناعهم بقدرتهم على التعبير عن القضايا التى تهمهم، أم بوصفهم مرشحين يناضلون، وفق قواعد منصفة، من أجل الفوز بالمقاعد التى يتنافسون للحصول عليها . ومن ثم كانت ممارسة المشرع لسلطته التقديرية فى تنظيم هذين الحقين رهنًا بالتقيد بالحدود والضوابط التى نص عليها الإعلان الدستورى، وبحيث لا يجوز له التذرع بتنظيم العملية الانتخابية سواء بالنسبة لزمانها أو مكان إجرائها أو كيفية مباشرتها، للإخلال بالحقوق التى ربطها الإعلان الدستورى بها، بما يعطل جوهرها أو ينتقص منها أو يؤثر فى بقائها أو يتضمن إهدارًا أو مصادرة لها .
          وحيث إن من المقرر فى قضاء هذه المحكمة أن مبدأ المساواة أمام القانون الذى قررته المادة (7) من الإعلان الدستورى المشار إليه ليس مبدأ تلقينيًا جامدًا منافيًا للضرورة العملية، ولا هو بقاعدة صماء تنبذ صور التمييز جميعها، ولا كافلاً لتلك الدقة الحسابية التى تقتضيها موازين العدل المطلق بين الأشياء، وإذا جاز للدولة أن تتخذ بنفسها ما تراه ملائمًا من التدابير، لتنظيم موضوع محدد أو توقيًا لشر تقدر ضرورة رده، وكان دفعها للضرر الأكبر بالضرر الأقل لازمًا، إلا أن تطبيقها لمبدأ المساواة لا يجوز أن يكون كاشفًا عن نزواتها، ولا منبئًا عن اعتناقها لأوضاع جائرة تثير ضغائن أو أحقاد تنفلت بها ضوابط سلوكها، ولا عدوانًا معبرًا عن بأس سلطاتها، بل يتعين أن يكون موقفها اعتدالاً فى مجال تعاملها مع المواطنين، فلا تمايز بينهم إملاءً أو عسفًا . ومن الجائز بالتالى أن تغاير السلطة التشريعية ووفقًا لمقاييس منطقية بين مراكز لا تتحد معطياتها أو تتباين فيما بينها فى الأسس التى تقوم عليها، على أن تكون الفوارق بينها حقيقية لا اصطناع فيها ولا تخيل، ذلك أن ما يصون مبدأ المساواة، ولا ينتقص محتواه، هو ذلك التنظيم الذى يقيم تقسيمًا تشريعيًا ترتبط فيه النصوص القانونية التى يضمها بالأغراض المشروعة التى يتوخاها، فإذا قام الدليل على انفصال هذه النصوص عن أهدافها، كان التمييز انفلاتًا لا تبصر فيه، كذلك الأمر إذا كان اتصال الوسائل بالمقاصد واهيًا، فإن التمييز يعتبر عندئذ مستندًا إلى وقائع يتعذر أن يحمل عليها، فلا يكون مشروعًا دستوريًا .
          وحيث إن مضمون مبدأ تكافؤ الفرص، الذى يتفرع عن مبدأ المساواة، ويعد أحد عناصره، إنما يتصل على ما جرى به قضاء هذه المحكمة بالفرص التى تتعهد الدولة بتقديمها، وأن إعماله يقع عند التزاحم عليها، وأن الحماية الدستورية لتلك الفرص غايتها تقرير أولوية تتحدد وفقًا لأسس موضوعية يقتضيها الصالح العام .
          وحيث إن من المقرر أن قيام النظام السياسى فى جمهورية مصر العربية على أساس التعددية الحزبية فى ظل دستور سنة 1971 ، والذى أكدته المادة (4) من الإعلان الدستورى إنما قصد إلى العدول عن التنظيم الشعبى الوحيد إلى تعدد الأحزاب ليقوم عليه النظام السياسى للدولة، باعتبار أن هذه التعددية إنما تستهدف أساسًا الاتجاه نحو تعميق الديمقراطية وإرساء دعائمها فى إطار حقى الانتخاب والترشيح اللذين يعتبران مدخلاً وقاعدة أساسية لها، ومن ثم كفلهما الإعلان الدستورى للمواطنين كافة الذين تنعقد لهم السيادة الشعبية طبقًا لنص المادة (3) من الإعلان الدستورى، ويتولون ممارستها على الوجه المبين فى هذا الإعلان، وليس أدل على ذلك من أن التعددية الحزبية هى التى تحمل فى أعطافها تنظيمًا تتناقض فيه الآراء أو تتوافق، تتعارض أو تتلاقى، ولكن المصلحة القومية تظل إطارًا لها ومعيارًا لتقييمها وضابطًا لنشاطها، وهى مصلحة يقوم عليها الشعب فى مجموعه، ولم تكن التعددية الحزبية بالتالى وسيلة انتهجها المشرع الدستورى لإبدال سيطرة بأخرى، وإنما نظر إليها باعتبارها طريقًا قويمًا للعمل الوطنى من خلال ديمقراطية الحوار التى تتعدد معها الآراء وتتباين، على أن يظل الدور الذى تلعبه الأحزاب السياسية مرتبطًا فى النهاية بإرادة هيئة الناخبين فى تجمعاتها المختلفة، وهى إرادة تبلورها عن طريق اختيارها الحر لممثليها فى المجالس النيابية، وعن طريق الوزن الذى تعطيه بأصواتها للمتزاحمين على مقاعدها، وهو ما حرص الإعلان الدستورى على توكيده، وكفالة حقى الانتخاب والترشيح، وجعلهم سواء فى ممارسة هذين الحقين، ولم يجز التمييز بينهم فى أسس مباشرتهما، ولا تقرير أفضلية لبعض المواطنين على بعض فى أى شأن يتعلق بهما، وإنما أطلق هذين الحقين للمواطنين الذين تتوافر فيهم الشروط المقررة لذلك على اختلاف انتماءاتهم وآرائهم السياسية، لضمان أن يظل العمل الوطنى جماعيًا لا امتياز فيه لبعض المواطنين على بعض، ومن خلال هذه الجهود المتضافرة فى بناء العمل الوطنى تعمل الأحزاب السياسية متعاونة مع غير المنتمين إليها فى إرساء دعائمه، وبذلك يتحدد المضمون الحق لنص المادة (3) من الإعلان الدستورى، الذى لا يعقد السيادة الشعبية لفئة دون أخرى، ولا يفرض سيطرة لجماعة بذاتها على غيرها، وفى هذا الإطار تكمن قيمة التعددية الحزبية باعتبارها توخيًا دستوريًا نحو تعميق مفهوم الديمقراطية التى لا تمنح الأحزاب السياسية دورًا فى العمل الوطنى يجاوز حدود الثقة التى توليها هيئة الناخبين لمرشحيها الذين يتنافسون مع غيرهم وفقًا لأسس موضوعية لا تحدها عقيدة من أى نوع، ولا يقيدها شكل من أشكال الانتماء سياسيًا كان أو غير سياسى، وعلى أن تتوافر للمواطنين جميعًا، الذين تتوافر فيهم الشروط المقررة لذلك، الفرص ذاتها التى يؤثرون من خلالها وبقدر متساو فيما بينهم فى تشكيل السياسة القومية وتحديد ملامحها النهائية، ومما يؤكد ذلك أن الإعلان الدستورى لم يتضمن النص على إلزام المواطنين بالانضمام إلى الأحزاب السياسية أو تقييد مباشرة الحقوق السياسية خاصة حقى الترشيح والانتخاب بضرورة الانتماء الحزبى، مما يدل بحكم اللزوم على تقرير حرية المواطن فى الانضمام إلى الأحزاب السياسية أو عدم الانضمام إليها، وفى مباشرة حقوقه السياسية المشار إليها من خلال الأحزاب السياسية أو بعيدًا عنها . ولا شك أن مبدأى المساواة وتكافؤ الفرص، وهما من المقومات والمبادئ الأساسية المعنية فى هذا الشأن، يوجبان معاملة المرشحين كافة معاملة قانونية واحدة، وعلى أساس من تكافؤ الفرص للجميع دون أى تمييز يستند على الصفة الحزبية، إذ يعتبر التمييز فى هذه الحالة قائمًا على أساس اختلاف الآراء السياسية، وهو الأمر المحظور دستوريًا، إذ لا يصح أن ينقلب النظام الحزبى قيدًا على الحريات والحقوق العامة التى تتفرع عنها، ومنها حق الترشيح، وهو من الحقوق العامة التى تحتمها طبيعة النظم الديمقراطية النيابية، ويفرضها ركنها الأساسى الذى يقوم على التسليم بالسيادة للشعب على ما تنص عليه المادة (3) من الإعلان الدستورى .
          وحيث إن من المقرر أن تفسير نصوص الإعلان الدستورى يكون بالنظر إليها باعتبارها وحدة واحدة يكمل بعضها بعضًا، وأن المعانى التى تتولد عنها يتعين أن تكون مترابطة فيما بينها بما يرد عنها التنافر، بحيث لا يفسَّر أى نص منها بمعزل عن نصوصه الأخرى، بل يجب أن يكون تفسيره متساندًا معها بفهم مدلوله بما يقيم بينها التوافق، وينأى بها عن التعارض .
          وحيث إن المادة (38) من الأعلان الدستورى الصادر فى الثلاثين من مارس سنة 2011 المعدل بالإعلان الدستورى الصادر فى 25 سبتمبر سنة 2011 تنص على أن " ينظم القانون حق الترشيح لمجلسى الشعب و الشورى وفقًا لنظام انتخابى يجمع بين القوائم الحزبية المغلقة والنظام الفردى بنسبة الثلثين للأولى والثلث الباقى للثانى "، وكان مؤدى عبارات هذا النص فى ضوء مبدأى المساواة وتكافؤ الفرص، وقواعد العدالة، أن حصر التقدم للترشيح لعضوية مجلس الشعب فيما يتعلق بنسبة الثلثين المخصصة للانتخاب بنظام القوائم الحزبية المغلقة فى المنتمين للأحزاب السياسية، يقابله قصر الحق فى التقدم للترشيح لنسبة الثلث الباقى المحدد للانتخاب بالنظام الفردى على المستقلين غير المنتمين للأحزاب السياسية، ذلك أن المشرع الدستورى قد اعتنق هذا التقسيم هادفًا إلى إيجاد التنوع فى التوجهات الفكرية والسياسية داخل مجلس الشعب، ليصير المجلس بتشكيله النهائى معبرًا عن رؤى المجتمع، وممثلاً له بمختلف أطيافه وتياراته وتوجهاته ومستوعبًا لها، لتضطلع بدورها الفاعل فى أداء المجلس لوظيفته الدستورية المقررة بنص المادة (33) من الإعلان الدستورى، فإن ما يناقض تلك الغاية ويصادمها ذلك النهج الذى سلكه المشرع بالنصوص المطعون فيها، إذ قصر التقدم للترشيح لنسبة الثلثين المخصصة للانتخاب بنظام القوائم الحزبية المغلقة على المنتمين للأحزاب السياسية، يؤكد ذلك ما نصت عليه الفقرة الرابعة من المادة السادسة من القانون رقم 38 لسنة 1972 المشار إليه المستبدلة بالمرسوم بقانون رقم 108 لسنة 2011، من أن تتولى الهيئة المختصة فى الحزب أو الأحزاب ذات الصلة إجراءات ترشيحهم بطلب يقدم على النموذج الذى تعده اللجنة العليا للانتخابات، على حين لم يجعل التقدم لنسبة الثلث الآخر المخصص للانتخاب بالنظام الفردى مقصورًا على المرشحين المستقلين غير المنتمين للأحزاب السياسية، بل تركه مجالاً مباحًا للمنافسة بينهم وبين غيرهم من أعضاء هذه الأحزاب على غير ما قصده المشرع الدستورى وهو ما أفصحت عنه المادة الأولى من المرسوم بقانون رقم 123 لسنة 2011 بإلغائها نص المادة الخامسة من المرسوم بقانون رقم 120 لسنة 2011 المشار إليه، وأكدته باقى النصوص المطعون فيها على النحو المتقدم ذكره وبذلك يكون قد أتاح لكل من مرشحى الأحزاب السياسية إحدى فرصتين للفوز بعضوية مجلس الشعب، إحداهما بوسيلة الترشيح بالقوائم الحزبية المغلقة، والثانية عن طريق الترشيح للنظام الفردى، بينما جاءت الفرصة الوحيدة المتاحة أمام المرشحين المستقلين غير المنتمين لتلك الأحزاب مقصورة على نسبة الثلث المخصصة للانتخاب بالنظام الفردى، يتنافس معهم ويزاحمهم فيها المرشحون من أعضاء الأحزاب السياسية، والذين يتمتعون بدعم مادى ومعنوى من الأحزاب التى ينتمون إليها، من خلال تسخير كافة الإمكانيات المتاحة لديها لدعمهم، وهو ما لا يتوافر للمرشح المستقل غير المنتمى لأى حزب، الأمر الذى يقع بالمخالفة لنص المادة (38) من الإعلان الدستورى، ويتضمن مساسًا بالحق فى الترشيح فى محتواه وعناصره ومضمونه، وتمييزًا بين فئتين من المواطنين يخالف مبدأى المساواة وتكافؤ الفرص، لما ينطوى عليه من التمييز بين الفئتين فى المعاملة وفى الفرص المتاحة للفوز بالعضوية، دون أن يكون هذا التمييز فى جميع الوجوه المتقدمة مبررًا بقاعدة موضوعية ترتد فى أساسها إلى طبيعة حق الترشيح وما تقتضيه ممارسته من متطلبات، والتى تتحقق بها ومن خلالها المساواة والتكافؤ فى الفرص، فضلاً عما يمثله ذلك النهج من المشرع من إهدار لقواعد العدالة، التى أكدتها المادة (5) من الإعلان الدستورى، والتى لا تنفصل فى غاياتها عن القانون باعتباره على ما جرى به قضاء هذه المحكمة أداة تحقيقها، فلا يكون القانون منصفًا إلا إذا كان كافلاً لأهدافها، فإذا ما زاغ المشرع ببصره عنها، وأهدر القيم الأصيلة التى تحتضنها، كما نهج فى النصوص المطعون فيها، كان منهيًا للتوافق فى مجال تنفيذها، ومسقطًا كل قيمة لوجودها، ومصادمًا من ثم لقواعد العدالة . وذلك العوار الدستورى يمتد إلى النظام الانتخابى الذى سنه المشرع وضمنه النصوص المطعون فيها، سواء فى ذلك نسبة الثلثين المخصصة لنظام القوائم الحزبية المغلقة أو نسبة الثلث المخصصة للنظام الفردى .
          وحيث إنه فى ضوء ما تقدم جميعه، يتبين أن نص الفقرة الأولى من المادة الثالثة برمتها، ونص الفقرة الأولى من المادة السادسة والمادة التاسعة مكررًا ( أ ) محددًا نطاقهما على النحو المتقدم ذكره، ونص المادة الأولى من المرسوم بقانون رقم 123 لسنة 2011 المطعون فيها، قد وقعت بالمخالفة لنصوص الإعلان الدستورى المشار إليها، مما يتعين معه القضاء بعدم دستوريتها .
          وحيث إن القضاء بعدم دستورية نص المادة الأولى من المرسوم بقانون رقم 123 لسنة 2011 يستتبع حتمًا وبحكم اللزوم سقوط نص المادة الثانية من هذا المرسوم بقانون، المرتبطة به ارتباطًا لا يقبل الفصل أو التجزئة .
          وحيث إنه متى كان ذلك، وكانت انتخابات مجلس الشعب قد أجريت بناء على نصوص ثبت عدم دستوريتها، فإن مؤدى ذلك ولازمه على ما جرى به قضاء هذه المحكمة أن تكوين المجلس بكامله يكون باطلاً منذ انتخابه، بما يترتب عليه زوال وجوده بقوة القانون اعتبارًا من التاريخ المشار إليه، دون حاجة إلى اتخاذ أى إجراء آخر، كأثر للحكم بعدم دستورية النصوص المتقدمة، وإنفاذًا لمقتضى الإلزام والحجية المطلقة للأحكام الصادرة فى الدعاوى الدستورية فى مواجهة الكافة وبالنسبة إلى الدولة بسلطاتها المختلفة، طبقًا لصريح نص المادة (49) من قانون المحكمة الدستورية العليا الصادر بالقانون رقم 48 لسنة 1979، إلا أن ذلك لا يؤدى البتة إلى إسقاط ما أقره المجلس من قوانين وقرارات، وما اتخذه من إجراءات خلال الفترة السابقة، وحتى تاريخ نشر هذا الحكم فى الجريدة الرسمية، بل تظل تلك القوانين والقرارات والإجراءات قائمة على أصلها من الصحة، ومن ثم تبقى صحيحة ونافذة، وذلك ما لم يتقرر إلغاؤها أو تعديلها من الجهة المختصة دستوريًا، أو يقضى بعدم دستوريتها بحكم من المحكمة الدستورية العليا إن كان لذلك ثمة وجه آخر غير ما بنى عليه هذا الحكم .
فلهذه الأسباب
                حكمت المحكمة :
أولاً : بعدم دستورية نص الفقرة الأولى من المادة الثالثة من القانون رقم 38 لسنة 1972 فى شأن مجلس الشعب المستبدلة بالمرسوم بقانون رقم 120 لسنة 2011 .
ثانيًا : بعدم دستورية ما تضمنه نص الفقرة الأولى من المادة السادسة من هذا القانون المستبدلة بالمرسوم بقانون رقم 108 لسنة 2011 من إطلاق الحق فى التقدم بطلب الترشيح لعضوية مجلس الشعب فى الدوائر المخصصة للانتخاب بالنظام الفردى للمنتمين للأحزاب السياسية إلى جانب المستقلين غير المنتمين لتلك الأحزاب .
ثالثًا : بعدم دستورية المادة التاسعة مكررًا ( أ ) من القانون المشار إليه المضافة بالمرسوم بقانون رقم 108 لسنة 2011 فيما نصت عليه من تضمين الكشف النهائى لأسماء المرشحين بالنظام الفردى بيان الحزب الذى ينتمى إليه المرشح .
رابعًا : بعدم دستورية نص المادة الأولى من المرسوم بقانون رقم 123 لسنة 2011 بتعديل بعض أحكام المرسوم بقانون رقم 120 لسنة 2011، وبسقوط نص المادة الثانية منه .
